Chicago Construction Porta Potty Counts
Federal OSHA sets the construction porta potty count for a Chicago job site: 1 toilet for up to 20 workers, 1 toilet seat and 1 urinal per 40 workers from 20, and 1 per 50 workers from 200. Weekly servicing keeps a long job supplied.
Illinois’ state OSHA plan covers only state and local government workers, so private construction in Chicago follows federal OSHA. A site without a sanitary sewer may use chemical toilets under 29 CFR 1926.51(c)(3), unless local codes prohibit them.
Chicago Special Event Permit Rules
A special event permit from DCASE is required for a temporary structure in the Chicago public way used for a special event. Violations carry a fine of $200 to $1,000 each under Municipal Code 10-8-335, and the sponsor pays it.
Chicago also sets event toilet counts. With more than 30 people present, you need at least 2 toilets. Past 600 people, add 1 more per additional 300 people or fraction.
At least 5 percent of the toilets, and no fewer than one, must be accessible in most cases. The DCASE accessibility guidance for outdoor events also calls for accessible portable restrooms on site, so add an ADA portable toilet to your event order.
Chicago Street Placement Permit Rules
A Chicago porta potty rental needs no building permit, but a unit on the public way raises a separate permit question. The city’s list of work needing no building permit includes installing, maintaining or removing a temporary non-sewer-type toilet, and temporary means 180 days or less.
The Chicago Department of Buildings page also says a temporary or permanent structure of any size on a public street, alley, sidewalk or parkway “generally requires” a separate public way use permit from the Department of Business Affairs and Consumer Protection (BACP). It does not say whether a portable toilet counts, and it gives no application steps or cost, so ask BACP before you place a unit there. Tell us the spot when you call, and we will plan delivery around it.

Chicago porta potty rental FAQs
Answers to common questions about chicago porta potty rental.
Does a hand-wash station need a building permit in Chicago?
No. Chicago's no-building-permit list covers a temporary non-sewer-type toilet or its associated hand washing equipment, as long as it stays at the same location for 180 days or less.
Does a Chicago crew that moves between sites need its own porta potty?
A mobile Chicago crew may not need one. Under 29 CFR 1926.51(c)(4), the OSHA toilet count does not apply to mobile crews with transportation readily available to nearby toilet facilities.
Does a one-day porta potty rental in Chicago include a service visit?
No. One service visit (pump, clean, restock) per week is included for every week the unit is on site, so a one-day rental has no service visit. Extra visits cost more.
Do Chicago events need accessible porta potties?
Yes, in most cases. At least 5 percent of the toilets, and no fewer than one, must be accessible to people with disabilities.
Can I get a porta potty delivered the same day in Chicago?
Same-day delivery is available. We answer calls 24 hours a day at (872) 326-9200, so call or chat with us with your address and start date.
